Location Release
This release (“Release”) will set forth the terms upon which Reflective Media Productions, LLC (“RMP”) may film, videotape, photograph, and record my property at or near the address listed below in the Breaking Strongholds Production for the opportunity to participate in the production, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I agree as follows:
I, the undersigned, hereby grant to RMP and its agents, licensees, successors, and assigns (collectively, “Licensed Parties”) the unlimited right and permission to use, and to authorize third parties to record and/or use, my property’s name, picture, likeness, and descriptive/historical information, and any material based thereon or derived therefrom, together with any other material, or to refrain from so doing, in any manner, and in any venues, productions, and/or media whatsoever, whether now known or hereafter devised, anywhere in the world in perpetuity, for any lawful purpose, including without limitation for the purposes of advertising or trade in promoting and publicizing the Licensed Parties and/or any projects or programs of RMP.
RMP shall own all right, title, and interest in and to any footage, photographs, and/or other recordings of my property in connection therewith (“Materials”). The Materials shall constitute work made for hire or if for any reason not considered to be a work made for hire, I hereby assign to RMP all right, title, and interest therein. I understand RMP is incurring expenses and/or undertaking commitments in express reliance upon the foregoing. I agree that I shall not have the right to terminate or rescind this Release or to enjoin or restrain, or to seek to enjoin or restrain, the production or exploitation of the Materials (or any productions in which the Materials are incorporated) or any advertising, promotion, publicity, or other materials produced in connection with the Materials.
The Licensed Parties shall have the unrestricted right to edit and modify the Materials, and I shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based upon invasion of privacy, defamation, moral rights, or right of publicity) arising out of any use, blurring, alteration, distortion, illusionary effect, and/or faulty reproduction, and/or use in any composite form of the Materials and/or my property’s name, picture, likeness, and descriptive/historical information.
I grant to RMP permission to bring personnel and equipment onto my property for preparing, rehearsing, filming, and recording of scenes and sounds for the production.
I have the full and exclusive right and authority to grant the rights granted hereunder, and I agree that this Release does not in any way conflict with any existing commitment on my part. This Release sets forth the entire agreement between RMP and me and shall be governed by the laws of the State of Texas applicable to contracts executed and to be fully performed therein. Any controversies or disputes arising out of or relating to this Release shall be resolved exclusively in either the state or federal courts located in Montgomery County, Texas, and I hereby consent to the personal jurisdiction of such courts over me.
